How to Legally Terminate Household Staff

Q: What happens if I need to terminate an employee?
Jorge: Terminating an employee requires careful handling.
If the termination isn’t justified by legal grounds, you may be required to pay three months’ salary, plus 20 days for each year worked, along with any accrued vacation and Christmas bonus (aguinaldo).
It is highly suggested you hire a lawyer to assist as the termination process typically involves formal notification through legal channels to avoid disputes. They will help you acquire the legal document needed to present to your employee at the time of termination.
Q: What if I suspect an employee is stealing?
Jorge: In Mexico, accusations of theft require hard proof, such as video evidence, to avoid defamation claims.
Without solid evidence, it can be difficult to terminate the employee for theft. Employers are encouraged to handle these situations cautiously.
Q: Can employees sue if there are disputes about their employment?
Jorge: Employees can sue for unpaid wages, improper termination, or lack of social security registration. However, having a signed contract and proper documentation of payments can protect you from legal risks. Mediation is often the first step in resolving disputes.
Q: Can employees sue me, and what should I do if they do?
Jorge: Employees can sue for improper termination, unpaid wages, or missing benefits. Having clear contracts and proof of payments will help you defend against such claims. The first step in any dispute is mediation.
Q: Do I need a lawyer for hiring and firing staff?
Jorge: While not legally required, consulting a lawyer is highly recommended to ensure all contracts are properly drafted and terminations are handled correctly. A lawyer can also assist with registering employees and managing disputes. I also recommend hiring an accountant to help with IMSS filings.
